1. App Description
Smater Brain is a brain training application that helps users sharpen their cognitive skills through fun and challenging games. The App includes various mini-games designed to test logic, memory, focus, and reaction speed, along with IQ tests to help users track their mental progress over time.
2. License to Use
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and use the App solely on devices that you personally own or control.
3. Acceptable Use
You agree not to use the App in any unlawful manner or in any way prohibited by these Terms, including but not limited to:
- Attempting to compromise, interfere with, or reverse-engineer the security or functionality of the App.
- Using the App for any commercial purpose without our written consent.
- Distributing any virus or malicious code related to the App.
- Cheating, manipulating scores, or otherwise tampering with game mechanics.
4. Intellectual Property
All content included in the App, including games, graphics, user interface, and code, is the property of Smater Brain or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.
5. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, timely, secure, or error-free. You are solely responsible for your use of the App and the results thereof.
6. Limitation of Liability
To the maximum extent permitted by law, Smater Brain shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use the App.
7. Changes to the Terms
We reserve the right to modify these Terms at any time. The modified Terms will be posted within the App or communicated through other appropriate means. Your continued use of the App after such modifications constitutes your acceptance of the changes.
8. Termination
We reserve the right to terminate or suspend your access to the App without prior notice if you violate these Terms. Upon termination, your license to use the App will cease, and you must delete the App from your device.
9. Governing Law
These Terms shall be construed and enforced in accordance with applicable laws and fundamental principles of equity, without reference to conflict of law provisions.
